Hybrid Fitness Wimbledon – Terms & Conditions

IMPORTANT: Please carefully read these Terms & Conditions before purchasing any

membership, credits, services, or goods with Hybrid Fitness Wimbledon. By making a

purchase, you are deemed to have accepted these Terms & Conditions in full.

1. General

1.1 The goods, services, memberships and classes listed on this website and provided

in our club are supplied by Hybrid Wimbledon Ltd, referred to as “we”, “us” or “our”.

1.2 The terms “you” or “your” mean the individual using this website and/or purchasing

any goods, services, memberships, or credits.

1.3 If you do not agree to these Terms & Conditions, you must not use this website,

purchase memberships/credits, or attend our facilities.

1.4 We reserve the right to update or amend these Terms & Conditions at any time. It is

your responsibility to check them before each purchase or booking. Continued use of

our services after changes constitutes acceptance of the revised Terms & Conditions.

1.5 All payments are processed securely via Stripe Inc.. By purchasing from us, you

agree to Stripe’s Terms & Conditions in addition to ours.

2. Memberships

2.1 A “membership” means any purchase of ongoing services paid monthly in advance.

2.2 Your membership agreement begins once you complete the joining process online

or in club, provide payment details, and accept these Terms & Conditions.

2.3 By joining, you agree to pay all fees applicable to your chosen membership type.

2.4 Membership fees are collected monthly in advance. The initial payment is taken on

the date of purchase, and further payments are taken on the same calendar date each

month.

2.5 All payments are non-refundable, except where required by law.

2.6 If your payment fails, we will re-attempt collection on:

• +1 day

• +2 days

• +3 days

• +7 days

During this period, your membership and access to facilities will be suspended.

2.7 If payment remains outstanding after all attempts, your membership will remain

suspended until the balance is cleared. Additional collection fees may apply.

2.8 Defaulting payments & charges: If my bank fails to make a direct debit payment from

my account, I will be contacted by my Club. Missed payments may incur a late fee &

result in the suspension of my membership. We reserve the right to refer unpaid arrears

to a debt collection agency after being in arrears for a period of 78 days.

3. Cancellations/Eary termination requests.

3.1 Notice Requirement:

• Members who joined after 01/03/2024: 1 full calendar month’s notice

required and must be outside of their minimum commitment period.

• Members who joined before 01/03/2024: 7 days’ notice required.

3.2 Cancellations must be made in writing:

• Via the Hybrid Fitness App (if applicable), or

• By email to: wimbledon@hybrid-fit.co.uk

3.3 Direct debit or card cancellation does not constitute notice. Membership remains

live and payable until correct notice is received.

3.4 Membership must be active (not frozen) before cancellation can be processed.

3.5 Your membership will remain active (and fees payable) during your notice period.

3.6 You may only cancel within your commitment period under the circumstances listed

in clauses 3.7- 3.10.

3.7 Cooling Off period: a 14 day Cooling Off period is calculated as follows: your

membership start date is counted as Day 1 of the Cooling Off period. You may terminate

your membership within the first 14 days of this agreement by giving notice to the

Manager of the club via the link above. If you cancel your direct debit instruction for the

payment of fees this does not constitute service of notice. If you terminate this

agreement during the Cooling Off period you will be entitled to a refund of the initial

payment made including any joining fee, less a deduction for any use of the facilities (3

or more visits in any 7-day period will be treated as a full week's use)

3.8 Medical: you may terminate this agreement by giving at least 1 calendar months'

notice if you are unable to use the Club through serious illness or injury likely to

preclude you from using the Club for a period of at least 6 calendar months. We reserve

the right to require reasonable evidence of your illness or injury - e.g., a doctor's

certificate.

3.9 Relocation: You may request to cancel your membership if you move outside of a

10-mile radius of the location of the Club within the Commitment Period. Proof of your

new address must be provided with your cancellation request. Documents which are

acceptable as proof of your new address include: utility bills (gas, water, electric),

council tax bill, formal tenancy agreement, house purchase agreement, all of which

must be current (dated within the last 2 months) to be provided at the same time as the

written notice of termination.

3.10 Redundancy: You may request to cancel your membership the event you are made

redundant from your main employment. Your request must include the provision of a

redundancy letter if approved, your membership will terminate 1 full calendar month

after acceptance of cancellation.

4. Freezing Memberships

4.1 Memberships may be frozen for up to 3 months per calendar year.

4.2 Freezes must be requested in full monthly blocks (minimum 1 month).

4.3 Freezes run from the start to the end of your billing cycle.

4.4 If you unfreeze early, a pro-rata fee will be charged for the remainder of the billing

cycle.

4.5 Memberships cannot be cancelled whilst frozen – the freeze must end before notice

can be submitted.

5. Credits & Bundles

5.1 Non-members must purchase credits to access classes or facilities.

5.2 Credits are non-refundable, non-transferable, and must only be used by the account

holder.

5.3 Credits have expiry dates as advertised. Expired credits will not be refunded or

reinstated.

5.4 Late cancellations (less than 2 hours before class start) will result in a £2 fee.

5.5 No-shows will result in a £5 fee.

5.6 Buddy Credits (when issued) are valid for 1 month only and cannot be extended.

6. Club Rules & Conduct

6.1 Members and class users must be 16 years or older and in good health.

6.2 We reserve the right to refuse entry, suspend, or cancel memberships where rules

are breached, or behaviour is deemed unsafe or inappropriate.

6.3 By entering the club, you consent to photography/videography being taken for

promotional purposes. If you do not wish to be included, please notify staff prior to

participation.

7. Offers & Promotions

7.1 All offers are time-limited, subject to availability, and may be withdrawn at any time.

7.2 Offers cannot be used in conjunction with other promotions and are not

redeemable for cash.

7.3 Opening/pre-sale offers apply only to new members and remain valid only while the

membership is active.

8. Privacy & Data Protection

8.1 We collect, store, and process personal data in line with UK GDPR and ICO

guidelines.

8.2 Details of how we process and safeguard your data are outlined in our Privacy Policy,

available on our website.

9. Health Declaration & Liability

9.1 By purchasing a membership or credit, you confirm that you are physically fit and

able to take part in exercise.

9.2 You must inform staff of any relevant health conditions and update us of any

changes.

9.3 You participate at your own risk. While we take all reasonable precautions, exercise

carries inherent risks including (but not limited to) minor injuries, serious injury, or

death.

9.4 Hybrid Fitness, its staff, and contractors accept no liability for injury, loss, or

damage sustained on the premises, except where directly caused by our proven

negligence.

9.5 Ear protection is available for classes with amplified music, and its use is strongly

recommended.

10. Legal

10.1 These Terms & Conditions are governed by the laws of England & Wales.

10.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England

& Wales.

10.3 If any part of these Terms & Conditions is deemed invalid or unenforceable, the

remaining clauses shall continue in full effect.
